By accessing or using the Website or Services, users acknowledge and agree to be bound by these Terms together with any policies referenced herein, including the Privacy Policy and Cookie Policy.

Users acknowledge that regulatory requirements may change without notice, verification outcomes may depend on third-party providers and regulatory authorities, QPACT does not control governmental or regulatory decisions, and Services may be unavailable in certain jurisdictions or circumstances.

QPACT reserves the right to refuse or discontinue Services where provision of the Services may violate applicable law, create regulatory risk, expose QPACT to liability, or involve suspected fraud, sanctions risk or unlawful activity.

9. Prices, fees and refunds

All pricing displayed on the Website is provided in good faith and may be updated from time to time without prior notice.

Prices are stated in GBP unless otherwise indicated and may be subject to VAT or other applicable taxes.

By submitting payment for any Service, you agree to pay all applicable charges associated with the requested Service.

QPACT reserves the right to amend pricing, correct pricing errors or inaccuracies, refuse or cancel orders affected by pricing or technical errors, and pass through third-party or governmental fee increases where applicable.

Where an order is cancelled due to pricing or technical error after payment has been received, any amounts paid by the user in respect of the affected Service shall be refunded.

Users are responsible for providing complete, accurate and current billing and payment information.

Refunds

You may request cancellation and a refund before processing of the relevant Service has commenced.

Refunds may be available where:

  • the user decides not to proceed with identity verification before verification processing begins;
  • QPACT or its verification providers are unable to complete identity verification;
  • we are unable to provide the Service for operational or compliance reasons.

Once identity verification or compliance processing has begun, refunds may not be available.

Refund requests should be submitted to support@qpact.co.uk.

We reserve the right to refuse refunds where required information or documents are not provided, verification cannot be completed due to inaccurate or misleading information supplied by the user, or legal or compliance obligations prevent continuation of the Service.

10. Intellectual property

All intellectual property rights in and to the Website, Services and related materials, including trademarks, logos, branding, text, graphics, software, workflows, databases, designs, documentation and Website content, are owned by or licensed to QPACT and/or Persona Finance Ltd unless otherwise stated.

Nothing in these Terms grants users any ownership rights in the Website or Services.

Users are granted a limited, revocable, non-exclusive and non-transferable right to access and use the Website solely for lawful personal or internal business purposes in accordance with these Terms.

QPACT reserves all rights not expressly granted under these Terms.

Users acknowledge that identity verification outcomes may depend on third-party providers, Companies House requirements and information supplied by the user, and that Services may be delayed, restricted or refused for legal, compliance, fraud prevention or operational reasons.

Indemnity

You agree to indemnify and hold harmless QPACT, Persona Finance Ltd, its directors, officers, employees, contractors and affiliates from and against any claims, liabilities, damages, losses, costs and expenses arising from your misuse of the Website or Services, your breach of these Terms, inaccurate or fraudulent information supplied by you, or your violation of applicable laws or third-party rights.

Limitation of liability

To the fullest extent permitted by applicable law, QPACT, Persona Finance Ltd and their respective directors, officers, employees, contractors, affiliates and service providers shall not be liable for indirect, consequential, incidental, special or punitive damages, loss of profits, loss of revenue, loss of business, loss of anticipated savings, loss of opportunity, loss of goodwill or loss of data.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded or limited.

To the extent permitted by law, QPACT’s total aggregate liability arising in connection with the Services shall not exceed the total amount paid by the user to QPACT for the specific Service giving rise to the claim.

Please include your full name, relevant order details and details of the complaint.

QPACT shall not be liable for delays, interruptions or failures resulting from events beyond our reasonable control, including internet or telecommunications failures, cyberattacks, third-party provider outages, industrial disputes, natural disasters, acts of government or regulatory changes.

Assignment
